    Default Sample Clearance : Who's Responsibility?

    Who's responsibility is it to get a song's samples cleared? Is it the artist or the producer?

    It seems as if it'd be more of the artist's responsibilities. A producer can sample 10 songs, pay out the ass to use the samples, and then never sell the beats. If anyone can clarify, let me know.

    the record label deals with that shit.
    and you have to pay before u put out the song (before u start recording cuz if u can't use the sample worked for nothing and studio's cost money to rent (sometimes 1000$/hour))

    I'm not sure actually. Seems like maybe the producer should if he's actually gonna sell it. Cause if a producer sells a sampled beat that hasn't been cleared, then he just made money off of somebody else's work. But then again, I see your point too.

    I heard that it can go either way though. Depends on the details of how you sell the beat I think. You can tell the artist that a beat contains a sample and they must get it cleared before they can actually use it. Then the artist would go through a lable and they would go through a company that helps clear samples.

    Clearing samples can be costly, and also take a long time dependin on who u dealin wit.
    Best to have a manager or record company to deal wit that shit.

    There are places that handle sample clearing...I like to think it's the artists job to handle the clearances

    it will be the record label coz they have paid for rights to the song and every thing in it but if it's a sample cd it will probably be royalty free

    if ur singed to a major label, they will help deal with that shit...if ur an indie artist, u need to contact the people urself and ask for permission...and as far as the artist/producer issue, thats something u 2 need to work out to pay, u both really should help pay

    sometimes the songs are made before the samples are cleared

    My name is...by eminem...that song was already made before Dre asked Labi Siffre to use the sample...Labi said eminem had to change his lyrics because there was too much drug and gay bashing

    most people sell the beats and hand the artists all the info on the samples used so they can contact the people themselves. I was pretty shocked when I found this out, I thought you would buy the beat and be done with it, but I guess not. I'm sure the major producers do otherwise, like they said the labels would take care of it.

    most of the time the artist clears (then again not everyone is signed to a label)

    if youre not signed to a label then youre fucked basically, unless the publishers/artists are cool with it for little or no money.

    this doesnt work out too well if youre on the come up or w/e and dont have the bread to clear samples.


    smartest thing to do if youre in that situation is to just use a bunch of uncleared beats for a demo tape or some shit and send it around
