does that mean we have to learn how to play the guitar, violin, drums, etc. so that we can use them?

hasnt it been like that for years, back when eric b was sampling james brown and preemo sampling kool and gang back it 87 and 89?

its always been like that, only they are saying that you have to pay for eveything (thats B.S.) If somebody samples a track off some little indie label and gets permision. they would most likely get it for free, but major labels will charge the hell out of your a**. basicaly its a way for artists to protect theyre music and labels to make extra $$$ by sueing the sh** out of people

thats why i never messed around with samples to begin with.....

Maybe the samples that are more than 3 seconds long but the drums, nah because those dont even be the actual drums i have so many kits with the exact drums that would be dumb as hell to sue someone over a drum lol.

Samples-I would be pretty damb sure-refers to samples, of more than three seconds from a song, not individual tones such as drums, strings, horns, ect.

You can't copywrite the tone of a sound, only a string of tones. That means that if you use the exact same sound from another atrists track-but in a different melodic interpretation, its not illegle/where as, if you use a slightly different sound, but copy another artists, melodic line that is illegle.

Thats my overstanding anyhow.

90 percent of producers sample tracks, wether it be a small amount that most dont even really notice or the whole melody based on it. pretty much the RIAA is out to kill underground dj's and remixes all together (look at DJ Drama for example). they put filters on myspace to block unauthorized music, this will soon be on soundclick.com (which they just deleted my account for), rapidshare and alot of the popular upload sites.

they are also trying to stop the distrubution of acapella's as well, but they are not likely to go after small fish like us. They are more worried about people making a profit by using other peoples sh**, so if your selling sampled beats you might want to try and get authorization (never hurts to ask, and who knows they might hook it up for free). Or if you get popped you can always plea ignorance.

Unless your making money off it they will most likely just tell you to stop doin that sh** and keep an eye on you for a little while, look at all the sites that recently got turned in for it ( thanks to beef and people selling eachother out ). nobody got sued. they shut down for a week or so and now they are back up.

Basicaly if you do it / get caught and they say stop, then stop. I just keep it as a hobby, but if somebody puts a little $$$ in my face then I wont turn it down, I'll just suggest that they get the samples cleared before using it

if your music contains a sample that you no about then you you cannot sale or distrubute the product so u can make all the sample beats you want as long as it is practice

now as far as obtaining the licence you have to get the premission from the lable or the owner of the master you wish to sample

and after 75 years you dont have to pay for shit so tha older your sample tha better off you are

no doubt - most of my favorite songs have samples... i was talking about my beats tho
