A Brunswick teen is accused of disposing of her newborn baby by throwing the infant in the garbage.
Police say 18-year-old Victoria Leigh McGivern gave birth to the boy in early April and then put the newborn in a trash can.
"This was a child. It was a baby boy. He wasn't a piece of trash and he shouldn't have been treated as such," Rensselaer County District Attorney Patricia DeAngelis said.
The district attorney says McGivern put her new born baby in the trash right after she gave birth. DeAngelis says it happened at the girl's home on 84 Leversee Rd. Police found the baby the next day after McGivern went to Samaritan Hospital to be treated for complications from giving birth.
"The police were called in. She was questioned. She admitted she did in fact have a child in her home. It was a baby boy and she threw the baby boy in a trash can in her home," DeAngelis said.
DeAngelis says McGivern will not face homicide charges. She says that's because an autopsy of the infant could not determine if the baby was born alive, and McGivern will not admit that either.
She faces a charge of unlawful disposal of a body.
"The charge is an unclassified misdemeanor. It's not a regular misdemeanor. So she's not facing a year in jail. She's facing only 60 days in jail for throwing this baby in a trash can," DeAngelis said.
The district attorney says there are options out there for young women who give birth and don't want to keep the child. Samaritan Hospital participates in a program called Project Safe Haven. They'll take newborn, contact social services and find a home for the baby.
"Bring the baby to us. We will find a safe place for it and care for it, no questions asked. You can walk away," said Judy Quinn of Samaritan Hospital.
The Safe Haven law is nationwide.
In New York a newborn can be dropped off at a hospital, a police station or a fire station. But the baby has to be handed to a person -- not just left on a door step.
